In India, children aged 6–18 with a recognised disability have a legal right to free, inclusive education under the RPwD Act 2016 and RTE Act 2009 — schools cannot refuse admission, and your child is entitled to reasonable accommodations, accessible facilities and exam concessions. Every child has the right to learn alongside their peers — and in India, that right is written into law, not left to chance.

Your child with a disability has a clear legal right to free, inclusive education in India. Under the Rights of Persons with Disabilities (RPwD) Act, 2016 and the Right to Education (RTE) Act, 2009, children aged 6–18 with any of 21 recognised disabilities are entitled to free schooling, reasonable accommodations, and the support they need to learn in a regular ('neighbourhood') school. Schools cannot refuse admission on grounds of disability.

To claim several of these benefits, a child usually needs a disability certificate (issued by a notified medical authority) and a UDID card (Unique Disability ID). These open the door to scholarships, fee benefits and examination concessions.

How to put these rights into practice

1. Approach your neighbourhood school and ask for admission — keep a written record. 2. Obtain a disability certificate and UDID card if you don't yet have one. 3. Request a written accommodations plan and meet the teacher to agree on supports. 4. If admission is refused or support withheld, you may approach the District/State Disability Commissioner or the school authority in writing.

Can a school in India refuse to admit my child because of a disability?

No. Under the RPwD Act 2016 and RTE Act 2009, a neighbourhood school cannot deny admission on the grounds of disability. Children aged 6–18 with a recognised disability are entitled to free, inclusive education with the support they need.
