What the reservation actually means

In higher education — Under Section 32 of the RPwD Act, 2016, all government-funded and government-recognised higher-education institutions reserve a minimum of 5% of seats for students with benchmark disabilities (generally a 40% or greater degree of a specified disability, certified by a competent medical authority).

In schools — Children aged 6–18 with benchmark disabilities have the right to free education up to age 18 (Section 31). The Right to Education framework supports inclusive education in neighbourhood schools, so reservation here works through inclusion and access rather than a fixed seat quota.

What comes with it — beyond the seat itself, the law provides for:

  • Reasonable accommodations and accessible learning materials
  • A scribe, extra time and other concessions in examinations
